The Company wishes to announce that in 2012, B Tinjar (“Plaintiffs”) filed two suits in Miri High Court (“Court”) under suit no. MYY-22-12/6-2012 (Suit No. 1) and MYY 22-24/8-2012 (Suit No. 2) against RH Niga, RH Anchum (for Suit No.1) and RH Balang (Suit. No. 2) (“collectively referred to as the “Defendants”) following the illegal acts of the Defendants of trespassing into Bukit Limau Estate (Lot 15 Tinjar Land District) (subdivided into Lots 2,3 (now known as Lot 22), 6 and 9  of Block 32) and harvesting as well as removing the fresh fruit bunches from the said Estate. B Tinjar is the Provisional Lease Holder of the said Lot 15 Tinjar Land District.

The Defendants filed in their respective defence and claim that areas within the Provisional Lease of Lot 15 Tinjar Land District are their Native Customary Land (“NCL”).

On 29 November 2012, the Court ordered for the two suits (Suit No. 1 and Suit No. 2) to be tried together.

On 28 May 2015, the Court ruled that the Plaintiff (B Tinjar) have proven their case.

The claims of native customary rights by Defendants over Lot 15 Tinjar Land District were dismissed by the Court.

Damages were granted by the Court to the Plaintiff to be assessed following findings that the Defendants were liable for their wrongful acts.

The Court further awarded RM30,000 as global cost sum to the Plaintiff.
